By traders we are talking about new and used car dealerships, wholesalers, recyclers as well as importers and exporters. Our community is therefore made up of members holding merchant or sales permits issued by their respective province.

In just a few years, the automotive world has experienced great changes caused by various factors, which has led us all to become creative with our transactions in order to obtain the most profits or avoid most losses, depending on the situation.

We have witnessed unethical practices between merchants and auctions favoring a certain type of customer only, focusing only on sales, leaving their customers to their own devices during arbitration settlements and neglecting a good number of independent traders. SECTION I - General conditions of use

Intellectual property

  • Intellectual property rights: All content present on the BIDACTION platform, including, but not limited to, texts, graphics, logos, icons, images, audio clips, videos, data, the software and other content (collectively referred to as “BIDACTION Content”), are the exclusive property of BIDACTION or its licensors and are protected by intellectual property laws, including, but not limited to, Copyright, trademark, patent and trade secret laws.
  • Authorized use: You are authorized to use BIDACTION content only as part of your commercial use of the BIDACTION platform. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, publish, download, store or transmit any content from BIDACTION without the prior written permission of BIDACTION or the applicable rights holder, except where expressly permitted by these Terms of Use or applicable law.
  • Rights and authorization granted to users: By using the BIDACTION services, you grant BIDACTION and its users the right to use, reproduce, distribute, prepare derivative works, publicly display, publicly perform and otherwise exploit the content that you submit, upload, publish or display on the BIDACTION platform (referred to as “your content”) as part of the provision of BIDACTION services and its commercial operation.
    You acknowledge and agree that this license allows other BIDACTION users to access your content via the BIDACTION platform, to use it in accordance with these terms of use, and to share your content with other users via various means of sharing and communication integrated into the BIDACTION platform.
    You warrant that you hold all rights necessary to grant the aforementioned rights to BIDACTION and its users, and that your content does not violate the intellectual property rights, privacy rights or any other rights of any third party. You agree to defend, indemnify and hold harmless BIDACTION and its users against any claims arising from or related to your content.
    This policy survives even if you stop using BIDACTION services or if your account is terminated, withdrawn or deleted for any reason.
  • Electronic Signature Consent: BIDACTION, their affiliates and service providers may send you certain communications, notices, agreements, billing statements or disclosures in writing (“Communications”) regarding our products or services (“Services”). Your agreement to this Electronic Signature Consent confirms your ability and consent to receive communications electronically, rather than in paper form, and to the use of electronic signatures in our relationship with you (“Consent”). If you choose not to accept this Consent or if you withdraw your consent, you may be restricted in your use of the Services.
  • Electronic delivery of communications and use of electronic signatures: Under this Consent, BIDACTION may deliver all Communications electronically by email, SMS, or by making them accessible via BIDACTION websites or applications. Communications include, but are not limited to ;
    1. The agreements and policies necessary for the use of the Services (for example, this Consent, the BIDACTION Privacy Policy, the guide and terms of use of the BIDACTION Services);
    2. Payment authorizations and transaction receipts or confirmations;
    3. Account statements and history;
    4. All federal and provincial tax statements and documents. We may also use electronic signatures and obtain them from you.
  • Protection of rights: BIDACTION respects the intellectual property rights of third parties and expects users of the platform to do the same. If you believe that your content has been used in a way that violates your intellectual property rights, please contact BIDACTION in accordance with BIDACTION's copyright policy.

Limitation of Liabilities

  • You acknowledge that BIDACTION does not control and is not responsible for user-generated content or actions of users of the platform. BIDACTION cannot therefore guarantee the accuracy, completeness, reliability or relevance of the information provided on the platform. You use BIDACTION information and services according to your own judgments and assume responsibility for your own content and your interactions with other users.
  • BIDACTION assumes no liability for any direct, indirect, incidental, consequential or special damages arising from or related to your use of the platform, including, but not limited to, loss of data, service interruptions, property damage, lost profits or third party claims.
  • Federal, provincial and local laws prevail and supersede the regulations and terms of use below, where applicable. In this case, BIDACTION's liability will be limited to the fullest extent permitted by applicable law.

Applicable laws

By using BIDACTION services, you agree that any dispute arising from or related to the use of BIDACTION and/or arising from or related to a purchase or sale made via the BIDACTION auction platform, will be resolved exclusively through of the BIDACTION arbitration system. By accepting these terms of use, you expressly waive any right to go to court, and you agree to comply with the arbitration process and to appoint BIDACTION as arbitrator and authorize it to render a final decision and binding for the resolution of any dispute.

*BIDACTION's arbitration rules and procedures are based on NAAA (National Auto Auction Association) policy and will be applied in a manner binding and enforceable on all parties involved in a dispute.

SECTION III – Obligations of buyers and sellers

All customers must hold a valid merchant license and have previously completed the documents sent by email when applying for registration.
